Understanding Arizona’s Eviction Process

Evictions in Arizona move fast — sometimes from notice to lockout in just two weeks.
This speed leaves little room for families to find help, yet eviction is preventable with the right support.

What Happens

  1. Notice from the Landlord

    • For nonpayment, tenants receive a 5-day notice to pay or move.

    • For other lease issues, landlords must give 10 days to fix the problem.

  2. Court Filing

    • If not resolved, the landlord files an eviction (FED) case in Justice Court.

    • Hearings are often scheduled within 3–6 business days.

  3. Court Hearing

    • Tenants can raise defenses — including proof of payment, repair issues, or improper notice — but many face court without legal representation.

    • If the tenant doesn’t appear, default judgments are common.

  4. Lockout

    • After a ruling, landlords can request a Writ of Restitution in just five days, allowing constables to change the locks.

Eviction prevention starts the moment a notice is posted — and continues through every stage of the process. Community-based legal advocates and tenant support programs are expanding access to justice and working to keep Arizonans stably housed.
